proGenia GmbH (hereinafter referred to as “proGenia”) takes the careful handling of personal data from its users and allies very seriously.

The protection of privacy and the preservation of personal integrity are human rights.

It is important to us that you can trust the protection of your personal data (hereinafter referred to as “data”) at proGenia at all times.

This privacy policy informs you about the processing of your data by proGenia GmbH when you visit one of our websites (hereinafter referred to as “website” or “online service”).

1 ACCESS AND RESPONSIBILITY

1.1 Our online service is accessible at the following internet addresses:

1.2 The privacy policy applies regardless of the domains, systems, platforms and devices (e.g. desktop or mobile) used on which our online service is run.

1.3 The data controller is proGenia GmbH, Rosengartenstrasse 8, 9404 Rorschacherberg, Switzerland.

2 PERSONAL DATA PROCESSED

Personal data processed as part of our online service includes:

  • Inventory data (e.g., names and addresses of registered users),
  • Contract data (e.g. services used),
  • Access data (e.g. the web pages visited on our online service) and
  • Content data (e.g. entries in the contact form).

3 LEGAL BASIS

3.1 Based on Article 13 of the Swiss Federal Constitution and the data protection provisions of the Confederation (Data Protection Act, DPA) as well as the GDPR, every person is entitled to protection of their privacy as well as protection against misuse of their personal data.

3.2 We will only process your data in compliance with the relevant data protection provisions, i.e., in particular

  • if the data processing is necessary for the provision of our contractual services, e.g. processing of orders, purchase orders and other integrated service functions,
  • if the data processing is required by law
  • you have given your consent to the data processing, or
  • on the basis of our legitimate interests in data processing (i.e. interest in the analysis, optimisation and economic operation and security of our online offer, in particular with regard to range measurement, the creation of profiles for advertising and marketing purposes and the collection of access data and use of third-party services).

4 ACCESS DATA AND LOG FILES

4.1 Based on our legitimate interests, we collect data about every access to the server on which our online service is located (so-called server log files). The access data includes the name of the website accessed, file, date and time of access, amount of data transferred, notification of successful access, browser type and version, information about your operating system, referrer URL (the previously visited page), IP address and the requesting provider.

4.2 Log file information is stored for security reasons (e.g. for the clarification of abuse or fraud). Data whose further storage is necessary for evidentiary purposes is exempt from deletion until the final clarification of the respective incident.

5 CONTACTING US

5.1 When contacting us (via contact form, e-mail, webshop, etc.), your details will be processed for the purpose of handling your enquiry and processing it.

5.2 Your details may be stored in our customer relationship management system (“CRM system”) or comparable enquiry organisation.

6 COMMENTS AND CONTRIBUTIONS

If you leave comments or other contributions, your IP addresses will be stored on the basis of our legitimate interests.

7 USER ACCOUNT

7.1 As a user of the website, you can optionally create a user account if you meet certain requirements. The user accounts are not public and cannot be indexed by search engines.

7.2 Within the scope of your registration and renewed logins as well as the use of our online services, we store your IP address and the time of your respective user action. The storage is based on our, as well as your legitimate interests in protection against misuse and other unauthorised use. This data is not passed on to third parties unless it is necessary for the pursuit of our claims or there is a legal obligation to do so.

7.3 You can view, edit or delete your data stored in your user profile (with the exception of your user name) at any time via our online service.

7.4 If you terminate your user account, your data relating to the user account will be deleted, unless its retention is necessary for legal reasons or you have consented to its retention by proGenia. It is your responsibility as a user to save your data before the end of the contract in the event of termination.

7.5 We are entitled to irretrievably delete all of your data stored during the term of the contract.

8 COOKIES

8.1 Cookies are used when using the website. Cookies have the purpose of personalising the website during your visit and thus making the use of the website easier, more pleasant and more meaningful. Cookies are small text files that the website transfers to the cookie file of the internet browser on your device and stores there for later retrieval, so that you can be recognised when you visit the website again, for example. A cookie typically contains the name of the domain from which the cookie originates, the “lifetime” of the cookie and a unique identifier.

8.2 The following types of cookies are used on the Website:

  • Session cookies: these are temporarily set cookies that remain in the browser’s cookie file until you leave the website. Session cookies are primarily required to enable you to use the website and, if necessary, to register, log in or place orders. Session cookies are deleted at the end of the browser session.
  • Persistent cookies: These remain in the browser’s cookie file for longer. The duration depends on the lifetime of the specific cookie. It can be indefinite or extend to deletion. Persistent cookies from the provider allow the website to remember the choices you have made (e.g. your registration details, the language you have chosen or the region you are in).

8.3 If you do not wish to accept cookies or web beacons, you can reject them and object to access to previously stored information by setting your internet browser accordingly.
The settings within the browser that allow you to do this differ from browser to browser. They can usually be found under “Privacy” or “Cookies” of the browser’s “Internet Options” or “Settings” menu. If you need help disabling or deleting cookies, you can refer to the “Help” menu within the browser. 8.4 Insofar as proGenia uses cookies when you call up and visit the website and thereby collects and processes data from you, the legal basis for this is Art. 6 para. 1 sentence 1 letter f DS-GVO. proGenia hereby pursues the legitimate interests of personalising the website for your visit and facilitating the use of the website.

8.5 It should be noted that it may not be possible to use all of the interactive features and functions of the website if cookies and/or web beacons are blocked or deleted.

9 GOOGLE ANALYTICS

9.1 We use Google Analytics, a web analytics service provided by Google Inc (“Google”), based on our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offering). Google uses cookies. The information generated by the cookie about the use of the online offer by the users is usually transmitted to a Google server in the USA and stored there.

9.2 Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. In doing so, pseudonymous user profiles can be created from the processed data.

9.3 We only use Google Analytics with IP anonymisation activated. This means that your IP address is shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. The IP address transmitted by the user’s browser will not be merged with other Google data. You can prevent the storage of cookies by setting your browser software accordingly; in addition, you can prevent the collection of the data generated by the cookie and related to your use of the online offer to Google as well as the processing of this data by Google by downloading and installing the browser plug-in available under the following link: http://tools.google.com/dlpage/gaoptout?hl=de.

10 PAYMENT SERVICES IN THE WEB SHOP

10.1 Payments via the webshop are made via the payment service provider Stripe Inc. For the payment process, you will therefore be technically connected to the payment systems of Stripe Inc. Personal data such as name, billing and delivery address, e-mail address, IP address, etc. are transmitted to Stripe Inc. in the process.

10.2 The entry of payment information and the payment process take place on the payment systems of Stripe Inc. This information is not stored or otherwise processed by us.

11 SAFETY MEASURES

We take organisational, contractual and technical security measures in accordance with the state of the art to ensure that the provisions of the data protection laws are complied with and thus to protect the data processed by us against accidental or intentional manipulation, loss, destruction or against access by unauthorised persons.

12 YOUR RIGHTS

12.1 You have the right, upon request and free of charge, to obtain information about your data that we have stored. In addition, you have the right to correct incorrect data, restrict processing and delete your personal data, if applicable, to assert your rights to data portability and, in the event of the assumption of unlawful data processing, to file a complaint with the competent supervisory authority.

12.2 You can object to the future processing of your data in accordance with the legal requirements at any time. You can also revoke your consent, in principle with effect for the future.
